租房的故事：不再租中国人的房（续4）

约好了晚上过去住的时间后，B特别“命令”要我明天配一把Room Key并给她寄过去，并反复强调这是为我好，因为一旦我自己把钥匙弄丢或反锁在房间里了，只有Key copy能帮我解决问题。我淡淡地答道，In a few days应该可以，但明天我没有时间，B则“要求”越快越好。

进了门，Z把钥匙给我。同时告诉我，B在下午曾给他Email，告知她与我之间还有问题没解决，如果我来，不能给我钥匙。我问了一下Email的时间，原来是B bluntly hanged up phone call之后。Z接着告诉我，后来B给他打电话，告知可以给我钥匙了。这是我第一次认识到B的极度愚蠢和对法律的无知，因为一旦我当日无法入住而告上法庭，B给Z的Email则是最好的证据。然而，生活的经验告诉我，很多中国大陆人都是如此，只不过程度不同罢了。

同时B拒绝做任何Move-in Inspection，也没有任何document in written.她Does Nothing不愿Make any effort,我一提，她就说自己很忙，自己家务事很多，等等中国人最常见的Excuse。她没有意识到，这其实是放弃了她自己作为房东的某些法定权益。

过了两天，我Duplicated the room key. After testing the duplicated key,  我给B发了个Email，告知it's duplicated and tested, will mail to her in a few days when I have time. 又过了两天，我Mailed the key to her, 又给B发了个Email，告知已经寄出。对这件小事，B从来就没有给我回过信，就象从来就没有发生过一样，我也不知B是否收到了。

住了几天，跟Roommate们主动寒暄了一下。这个House上下两层，每层3个房间，除了我，住了4个中国大陆来的留学生和一个美国人M。日常生活跟B没有关系，按时用PayPal交房租和Utility就行了。B嫌每月算Utility帐单麻烦，就每两个月算一次。其中由于B懒得按月交给Local Company，就每两个月都有一个Late Payment费，她当然算在众房客头上，也没人跟她计较。

房客X要搬走了，这时听到一些故事。X已经在这住了两年多，帮助B无偿打理了基本所有事情，比如Show Room，给来剪草的人预支Pay，平常接待来做House Maintenance的Labor，等等。我来看房的时候，无意中告诉了B房间里当时还有人住。后来B问是怎么回事，X老实说是自己的一个朋友来访，住了5个晚上。B就要求按Motel的价格与X结算，众房客哗然。讨价还价的结果是，按每天$25算，但B坚持要算6天，因为Motel有Check-in，Check-out的时间，但B坚持说不知道X的朋友是什么时候来去的，所以，必须要算成6天。B威胁要从Deposit里扣，所以，X无奈地屈服了。（由此可知，中国大陆人都对法律的无知，以及法律意识的淡薄）X搬走后，B曾要求我替她找房客，我间断地给她Update了一些情况，但没有找到房客，B从来就没有回信过。

听到了一些故事，发现B利用把持房客Deposit的Advantage，对房客做各种威胁，以让房客给自己免费无偿地做事，并以此为豪，因为她Does Remote Landlording,人都不用Show Up，就无成本地把事情办了，而办事的人还怕她。大陆房客们对B什么话都骂得出来，但真碰到什么事情时，还是乖乖照办，仅仅屈服于被扣Deposit的淫威罢了。我对此感到震惊并难过。而最终结束这种房客-房东关系时，B还是强硬地蛮横无理。比如，我房间里的前房客毕业后回中国大陆，B退还Deposit的条件是，要该房客做各种各样的事情，做完后，要该房客拍照片发给她，她根本就人都不来。由于房客是回大陆，所以，退房的当天上午就要去机场，B说，要Deposit的话，去机场的路上到她家里去拿。我问众房客，为何你们不把款项预支，然后让B从下月房钱里抠？没人回答我的问题。当然，我也感受到了，他们谨小慎微，是因为学生签证，不想惹什么麻烦，所以，对这种小事都一忍再忍。

有一天，收到一个Email，是前房客X发给B并CC所有房客的。我当时刚做了一笔DT，挣了半年的房租钱和生活费，心情不错，正在喝咖啡Enjoying。饶有兴趣地把整个Email History看了一下。简单点说，就是X搬出去了，做了所有房客该做的，也加做了后来B一再无理要求加做的鸡毛蒜皮的系列小事情，只不过是为了要回Deposit，但B最后却给他来了个：

你用PayPal付给我的最近某一笔帐，被Charge了Processing Fee，少了$7.xx，你得把这$7.xx给我，我才能还你Deposit。

X无奈，只得把整个Emai History CC给大家，说了句：“你把那个Charge了$7.xx的Transaction Number给我，我跟PayPal联系一下，看能不能给你解决”。

真是为X难过，为X曾帮助过B两年忙难过，为B难过，为中国大陆人之间居然在美国出现这种事情难过！

居然还有如此愚蠢的女人兼如此愚蠢的房东！

当时，X已经搬出去很久了，早已超出州法规定的在多少日之内必须还Deposit的时间。我就Reply to All：

1，If you are charged a processing fee, it's your own responsiblity to check with PayPal to find out the reason, it's none of the payer's business. Also, please advise us if you've ever been charged any processing fee from any other payer(s) on the list. I guess nobody wants to deal with any unnecessary hassle when moving out.
2，According to legal terms of the state law, landlords have no right to charge any deposit in the scenario decribed as below because there is nothing required in written. All requested and all done are just in good-will which, frankly speaking, makes nonsense because none of the roommate friends could legally act as manager on behalf of the landlord.
3，By state law, deposit return due must be paid back in XX business days (URL link:xxx.xxx.gov.xx). Failure to do so could result in the tenant filing lawsuit on court with claiming further penalty. (ie, even if the processing fee is of the tenant's problem in such a case, the landlord still needs to pay back the deposit return due in XX business days. The two are just simply different issues).(PayPal少了你$7.xx，即使是房客X的责任，也与Deposit无关，这是完全不同的两码事。PayPal少了你$7.xx，无论是谁的责任，没有法律规定如何处理；但还Deposit这事，是有法律规定的，在XX天内必须归还，你已违反法律，X可以上法庭告你，并追加Penalty)

另起一段：
In addition, could you please say a thank-you to me for duplicating and sending you the room-key? The bills, although in total just a few dollars, have been still kept so far for two months in case you need.

平常谁会把这duplicating key的事放在心上?但对待这种人，你不是虚构几块钱的事故意无理刁难别人么?就让你现回眼吧！

发出去一分钟内，房东Reply To All，Deposit Paid Out by PayPal。两分钟后，给我私下发了个Email:

thanks very much for copying the key and sent it to me.  please deduct the fee associated with it in your next rent payment or do you want me to send a paypal payment to you? please let me know the total that I am supposed to pay you back.  do you have the receipt still? (这最后一句问的真够蠢的！)

我回了个：
Thanks for the email. The receipts say:
 
dup 1.xx + tax 0.xx = 2.xx
stamp envelope 0.xx + overweight 0.xx = 0.xx
Total: 2.xx

I am sure that you enjoy your quality time with your family and all tenants have things to be busy with and enjoy by themselves. The USA is a great country where everything is law-enforced on the basis that everybody stands equal. It would be great for all to run things smoothly with common respect and minimum convenience good-will due for each other. Especially, nobody could benefit from trivial tractions.

发出去后，一分钟之内，Messenger通知我，PayPal付了我一笔款。

立刻，我又给她发了个Email，仔细说明了一下她托我找房客的目前进展。Oops，没回音，就是学不会 Appreciate or thank you!

点评：

中国人的占便宜有两种，一种是利用别人，得到不该得到的东西，一种是欺负别人，不给别人自己该给别人的东西。前者，对自己眼里的任何人都适用；后者，适用于认为不如自己的人、或自认为可欺的人，无论可欺的标准是什么。如果房东同时作为Roommate，找了房客帮了什么忙的，那么同样的忙，应该主动回应。这一点，大多数在美国的中国人做不到，而绝大多数美国人，无论什么素质，都超过了做得到。
