一个发明家的呼救

今天收到一个美国发明家组织的呼救邮件，控告苹果手表侵权。我没有看过该发明的具体内容，不做置评。

我有两个身份，一个是专利代理（patent agent）。如果有普通律师资格，然后通过专利法考试，就叫专利律师。如果没有律师资格但通过了专利法考试，就叫专利代理，可以在美国专利商标局代理客户办理专利申请审查复核等业务。我大约20年前考了专利法，列入了专利代理名录，所以会收到一些这方面的邮件，但我从来没有给任何人做过代理。

我的第二个身份，也就是真实身份是独立发明家，确切地说是爱迪生式的发明家，或者说是系统发明家。我也经常收到独立发明家组织的邮件，但系统发明家又是独立发明家中的另类。

独立发明家是技术创新的重要源泉，大约75%的重大技术创新来源于独立发明家。

专利法变异到目前的状况，越来越繁复，越来越费用昂贵，越来越维护垄断而偏离鼓励创新的初衷。

Masimo, an inventor founded US manufacturing company, needs US Inventor’s support.

Masimo was granted an ITC exclusion order on October 26, 2023, banning select Apple watches from being imported from China into the United States. The President has 60 days from the date of the exclusion order to allow or veto this order- December 25th.
