来自参考消息的报道称，与徐进、刘芳一家人在美国逍遥自在不同的是，EB-5真正受害者目前正在起诉加州投资移民基金会，希望能索要回各自的投资款。威廉.李（音）是4名真正受害者之一。

据美媒报道，包括李在内的4人，和徐进、刘芳不一样，

是真正希望投资EB-5项目的人。李等4名真正受害者正是此次联邦探员搜查加州投资移民基金会后，和徐进、刘芳等人一同被曝光的。

美国《洛杉矶时报》网站今年5月20日曾报道，在2011年把钱投给了加州投资移民基金后，李每年都会去洛杉矶。他说，每次都有一位代表带他参观兰乔库卡蒙加周围的各种空地，并向他保证，开发项目进展顺利。但这些项目从未动工。

在李等4人苦等重新投资EB-5项目时，徐进一家目前在美国却住豪宅、开豪车。据消息人士透露，徐进一家利用虚假身份和虚假收入证明办理了EB-5投资移民获得美国临时绿卡后，立即通过在美国的关系人购买了一套别墅和两台豪车。其女儿徐欣子在美国读本科和研究生时，一直租住豪华公寓楼，一家人经常开车环美旅行，过着逍遥自在的日子。该消息人士说，徐进一家在美的所有开销，均来自某商人的贿赂。

李和其他3名投资者5月19日向民事法庭提起诉讼，提出违约和其他多项指控。

李表示，如果他可以把钱要回来，他计划将其重新投资到EB-5计划。

熟知EB-5项目猫腻的华裔律师王丽（音）说，像李等4人确实是为了投资项目，为美国创造就业机会，进而移民美国；但像徐进、刘芳一家，完全就是为了逃入美国，根本不会考虑所谓的创造就业机会。“这几乎是以造假身份移民美国后所有人的做法。”

王律师介绍，这些假借EB-5项目移民美国的人，身价不菲，到美国要么是为逃避母国法律制裁，要么就是为了享受奢华生活。“很显然，徐进、刘芳一家这两条都占全了。”

有分析人士指出，美国眼下大规模“扫荡”华人移民律师，一方面堵住了一些人利用所谓“政治庇护”的漏洞，另一方面客观上对清查虚假EB-5项目起到促进作用。

The real victims of EB-5 filed a lawsuit against the Immigration Law Firm

According to the Reference News reports, while the Xu Jin and Liu Fang have a carefree life in USA, the real victims of EB-5 are filing a lawsuit against the California Investment Immigration Fund in the hope of recovering their investment. William Lee (威廉·李) (transliteration) is one of 4 real victims.

The American media reported that those 4 persons including Lee, different from Xu Jin and Liu Fang, really wanted to invest the EB-5 program. These 4 victims were exposed together with Xu Jin, Liu Fang, etc. during the search of the California Investment Immigration Fund by the FBI agents.

According to the reports from the Los Angeles Times on May 20, 2017, Lee went to L.A. every year after an amount of investment paid to the California Investment Immigration Fund in 2011. He said that a representative always visited various vacant lots around the Rancho Cucamonga with him and assured him that the projects would be successfully developed. However, those projects have never been constructed.

Xu Jin’s family are living luxuriously with houses and cars in USA while the above four victims are waiting for reinvestment in EB-5 program. According to the relevant sources, Xu Jin’s family immediately purchased a villa and two luxury cars through their related party in USA after obtaining the U.S. Conditional Green Cards by exploiting the EB-5 investment immigration program with false identities and income. Xu Jin’s family often drove around the United States and their daughter Xu Xinzi had been living a rented luxury apartment during her undergraduate and graduate periods. The source said that all the expenditures of Xu Jin’s family in USA were from the bribes offered by one businessman.

Lee and other 3 investors filed a lawsuit to the Civil Court on May 19, 2017, claiming the default and other accusations.

Lee said that he planned to reinvest in the EB-5 program with money that could be recovered.

The Lawyer Wang introduced that these immigrants with a lot of money through the EB-5 program are intended to escape from the legal punishment of their home country or to enjoy the luxury life. “Obviously, these two purposes are true for the Xu Jin’s family.”

An analyst pointed out that the reasons why the USA is extensively “cracking down” the Chinese immigration lawyers are to eliminate the so-called “political asylum” loopholes and to objectively promote the investigation of the false EB-5 program.
