老毕风波过去好多天了，可还是不断见到有人为他打抱不平，比如说这是他的“言论自由”，“他有骂的自由”，“起诉也没有任何法律依据”什么的，不一而足。其实每个人小时候家长都会教给你不要骂人，成人社会里不论在工作还是在家里骂人也都是被人不齿的，很多人也为此付出了很大的代价，比如失去公司、工作、甚至家庭。但既然那么多人以为可以随便骂人，那就从作为道德底线的法律上说一说老毕到底能不能骂人。
先看看普适价值的先驱法国可不可以骂。2003年1月23日法国通过了国内安全法，里面规定（http://www.theguardian.com/world/2003/jan/15/france.jonhenley）：
Swearing at a policeman, government official or any "person invested with public authority" could bring a fine of up to €30,000 (£20,000) and a two-year jail sentence, while uttering a death threat could cost €75,000 (£50,000).
就是说辱骂警察、政府官员、被公权授权的人员是犯法的，会判两年监禁并处罚金若干。
保护言论自由最力的普适国家美国联邦法院有判例说明从原则角度讲是不可以在可能立即引起暴力的情况下骂人。但各个州的法律又不一样，我们来看几个例子：
一、密执安州法律认为只要有女性和儿童在场骂人就是犯法的（http://www.legislature.mi.gov/%28S%28eblto5zu45pl4l431bfithvf%29%29/mileg.aspx?page=getObject&objectName=mcl-750-337&highlight=750.337）：

750.337 Women and children; improper language in presence.
Sec. 337.
Indecent, etc., language in presence of women or children—Any person who shall use any indecent, immoral, obscene, vulgar or insulting language in the presence or hearing of any woman or child shall be guilty of a misdemeanor.
二、俄克拉荷马州法律也认为只要有女性和儿童在场或在公共场合骂人就是犯法的（http://www.oscn.net/applications/oscn/DeliverDocument.asp?CiteID=69426）：

Section 906 - Obscene Language in Public Place, etc. - Punishment
If any person shall utter or speak any obscene or lascivious language or word in any public place, or in the presence of females, or in the presence of children under ten (10) years of age, he shall be liable to a fine of not more than One Hundred Dollars ($100.00), or imprisonment for not more than thirty (30) days, or both.
三、罗德岛比较严格地认为只要骂人就违法（http://webserver.rilin.state.ri.us/Statutes/TITLE11/11-11/11-11-5.HTM）：
TITLE 11 Criminal Offenses
CHAPTER 11-11 Disorderly Conduct
SECTION 11-11-5
§ 11-11-5 Profanity. – Every person who shall be guilty of profane swearing and cursing shall be fined not exceeding five dollars ($5.00).
还有很多州有类似的法律，不多说。除此之外，美国还有很多州有亵渎神明罪。中国有很多人在汽车里挂毛的像以求保佑，也可以算是神明了，何况毛是写在中国宪法、还有老毕还在的党的党纲里的。你当然可以不同意，可一个人的粗话是另一个人颂歌（One man's vulgarity is another's lyric），就像穆斯林和基督徒如何看待对方的宗教一样。
你一定会说这些都不是中国的法律，那我们来看看中国法律怎么说的（http://www.npc.gov.cn/wxzl/wxzl/2000-12/17/content_4680.htm）：
中华人民共和国刑法第二百九十三条 有下列寻衅滋事行为之一，破坏社会秩序的，处五年以下有期徒刑、拘役或者管制：
。。。
（二）追逐、拦截、辱骂他人，情节恶劣的；
。。。
知道了吧，骂人在中国也是犯法的。结论是老毕是不能骂人的，不论在哪。
