直面陪审团, 决战分雌雄 (四)

2013年5月23日, 美国雪城 (Syracuse, NY) 风和日丽, 鲜花怒放, 春色满园。人们一点也看不出, 这里曾经是暴风雪肆虐的地方。那天，一个联邦陪审团在雪城判决, 纽约州立大学技术学院（SUNY IT）没有续约前教授周序申博士的雇佣合约, 以报复他的投诉, 违反了一九六四年民权法第七章, 《美国法典》第42篇第1981节以及纽约州人权法。

该陪审团同时判决, Dr. Lisa Berardino (老板E), Dr. Stephen Havlovic (老板B), 和 Dr. William Langdon (老板A) 对纽约州立大学技术学院的报复违法行为, 负有个人责任, 违反了《美国法典》第42篇第1981节以及纽约州人权法。

陪审团并责令纽约州立大学必须赔偿周序申博士的全部欠薪。

至此, 四个被告, 一网打尽，无一漏网。所有指控，全部成立。真可谓法网恢恢，疏而不漏。

拥 有64个校园和八万八千名教员, 并培养出无数法官和律师的纽约州立大学（State University of New York，简称SUNY）是美国规模最大的综合性高教系统。其在联邦法庭败诉后, 美联社,《华尔街日报》, 《高等教育纪事报》（The Chronicle of Higher Education）, 以及纽约州立大学技术学院附近的几个城镇的报纸和电视台等媒体广泛报道了陪审团的判决。

纽约州政府的人权执法机构, 纽约州人权署 (New York State Division of Human Rights) 更是在推特(Twitter) 上发表了推文（Tweet）, 并在脸书上转发了报导。

Some suggestions:
If you review all the prof.'s publications, you can find whether those publications are truly written by him.

If you can find the other two Chinese Prof. who had similar experience as witness, your case would be convincing.

惩罚 is only for private entities, such as companies. You cannot punish the government.

This country has too many lawyers already, most of them are not good. Just say no to a law degree.

Beside, if I were in a big law firm, as a Chinese, I would only get half or a quarter of yearly bonus as other lawyers get, even if I can win more cases than others. This is a reality.

时传祥 2013-07-21 13:31:25 回复 悄悄话 Most people would just go away when their contracts not renewed. They are not familiar with the process of a lawsuit and usually try to stay away from it. So you are an exception, I have to say. So congratulations. I know it is hard work, and it takes a lot of courage to fight it. But I guess it gets easier once you know the process. I passed some of the links of the articles you listed to my friend. He does not have a formal litigation experience so i am sure your victory should help encourage him. Thanks!

The court has the thick menu for Pro se litigators, but went to the court hearing myself without a lawyer, arguing for many many hours just as though I were the lawyer. Did two depositions myself as though I were the lawyer. Had some help but no help when in the court.

Then the discovery and interrogatories, etc. Then appeal after the defendants' summary judgement was granted to dismiss the case. You had someone helping you?
时传祥 2013-07-21 13:05:35 回复 悄悄话 我有个朋友也在替人打类似的官司。原告已经回国，我朋友是tenure了，是同事，故拔刀相助。好像被告已经notice of motion for a summary judgement to dismiss the case。朋友在写answer 或叫 answering affidavit.看了你的case，觉得很像。
