上海市闵行区“莲花河畔景苑”楼房倒塌关键人物阙敬德

阙敬德,2009年6月27日上海倒塌楼房所属开发商梅都房地产的股东之一,迅豪置业的法定代表人,碰巧的是梅陇镇镇长助理也叫阙敬德。不知是碰巧同名,还是本是一人。网友称阙敬德(净缺德)在梅陇镇的背景很大。旗下的迅豪置业的所有项目都由政府特批的。上海迅豪置业公司在莘朱路968号,阙敬德家在望族苑。在记者辗转采访中,一直未能联系上其人。除了阙敬德之外,梅都房地产股东与政府公务人员“同名同姓”现象还有多人。

“ 莲花河畔景苑”13层楼倒塌事件发生后,公众普遍对该楼盘开发商的资质、背景表示质疑。互联网上甚至有网友贴出所谓该楼盘开发商上海梅都房地产开发有限公司(以下简称“梅都房产”)的注册登记记录,以显示该公司的实力根本不足以承建“莲花河畔景苑”的开发项目。为此,本报记者对相关信息进行了核对,除证实“梅都房产”的最新注册资本金为人民币1800万元以外,还发现该公司的股东中出现了和梅陇镇镇政府现职公务人员相同的姓名。

据“曝光资料”称,梅都房地产有24位股东。其中,法定代表人张志琴,工作单位是梅陇镇镇政府;另一大股东阙敬德来自上海迅豪置业有限公司,包括阙在内,一共有14名股东来自迅豪置业;另外有3名股东来自梅陇镇征地事务所,一名股东来自梅陇镇土地管理所;其他还有股东来自闵行动物疾病控制中心。仅有一名股东的工作单位是梅都房地产。此外,上海莲花河畔景苑的承建商上海众欣建筑有限公司也有两个人是梅都房地产的股东。

同名同姓不止一人

27日,上海市闵行区“莲花河畔景苑”一在建楼房倒塌,相关的9名主要负责人被政府部门控制起来;而在网络上,一项由网友发起的针对该楼盘开发商的“人肉搜索”正在进一步升级。一份名为“上海莲花河畔景苑倒塌楼盘最新资料曝光”的材料将开发商上海梅都房地产开发有限公司的所有股东及其身份全部曝光。在这份材料中,闵行区梅陇镇的镇长助理、征地事务所所长、梅陇资产公司总经理等头衔出现在主要股东名单中。

梅都房地产的主要股东确实与上述曝光资料中显示的股东一致,而其中几名股东的姓名也确实与闵行区梅陇镇政府部门的几位工作人员同名同姓。不过,记者几经周折却未能联系到材料中涉及的人士;闵行区委宣传部新闻办相关人士告诉记者,目前相关部门仍然在对莲花河畔景苑倒塌一事作调查,尚不清楚上述股东是否为相关政府部门的工作人员。

上海闵行区政府新闻办通告事故最新进展情况时表示:连续监测的数据显示,上述小区内其余房屋均安全;相关部门也在继续接待购房者的咨询,目前闵行区已有效控制相关开发商等相关人员以及资金,并继续在现场同购房者进行沟通。

其中,“阙敬德”不仅出现在梅都房地产的股东名单中,也出现在迅豪置业法人代表一职上;梅都房地产的另一股东,出资22.5万元人民币的张耀杰,则和众欣建筑的法人代表同名;梅都房地产股东“徐道安”和上海企业黄页导航中记载的莲花河畔景苑的物业管理公司——上海迅梅物业管理有限公司的法人代表姓名一致。

记者在调查中还发现,梅都房地产与迅豪置业共用同一个工商管理注册登记地址;而根据工商管理登记资料,梅陇镇征地事务所还是迅豪置业的直接出资人——1996年3月27日,正是梅陇镇征地事务所出资960万元人民币和梅陇实业总公司共同创办了迅豪置业。不仅仅是相关公司的股东和主要负责人同名同姓。梅都房地产其中几名股东还和梅陇镇政府下属管理单位的负责人同名同姓。

中共上海闵行区委员会党务公开网公布的梅陇镇“迎世博600天行动计划”总指挥部成员,梅陇镇镇长助理、资产公司总经理的名字也叫“阙敬德”;梅陇镇征地事务所所长张锦粱也和梅都房地产的股东同名同姓。值得注意的是,根据工商登记资料,截至3月31日,梅都房地产注册资金为1800万,张志琴的投资额为1158.75万元,阙敬德出资额为270万元,其余中小股东的出资额在一二十万间。

【网友曝光】仅一名股东工作单位来自梅都房地产公司

在上述资料公布后,阙敬德的身份被进一步“人肉搜索”。有网友报料他是“闵行区梅陇镇镇长助理”,同时兼梅陇镇资产经营管理公司的总经理。至此,梅都房地产、迅豪置业、众欣建筑三家公司,以及梅陇镇政府相关部门先后出现在此事的关联方中。

【身份核实】所有当事人无法联络上

由于同名同姓者众,为核实情况,《每日经济新闻》记者昨日逐一联系了上述一些股东。遗憾的是,记者几经周折却没有与他们联系上。采访中,众欣建筑的员工告诉记者,其法人代表张耀杰目前正在接受调查。

梅陇镇征地事务所的工作人员则表示,“曝光材料”中所罗列的何斌、付磊等人目前或调到各乡动迁部门,或已经退休;所长张锦粱目前也在忙于动迁事务;而其并不清楚上述人士是否同时为梅都房地产股东。记者随即请这位工作人员转告上述名单中的人士,请他们务必与记者联系,以澄清自己是否为梅都房产的股东。但是,截至发稿时,上述人士并未联系记者。

而此事件中的另一位关键人物,与梅都房地产股东姓名一致的梅陇镇镇长助理阙敬德,在记者昨日的辗转采访中,也未能联系上其人。

记者又就此事咨询了上海市杜跃平律师事务所律师杜跃平,杜跃平告诉记者,根据相关法律法规,国家公职人员不得担任企业的股东,以免有碍市场经营的公平公正。而征地事务所、镇政府、镇资产管理公司等与房地产开发有一定的相关性。如果上述机构的工作人员被证实确实是梅都房地产的股东,不免会有权力寻租的嫌疑。

不过,上述梅都房地产股东身份与梅陇镇政府下属职能部门、企事业单位负责人及工作人员重名事件,还有待进一步查实。闵行区委宣传部新闻办相关人士称,目前相关部门仍然在对莲花河畔景苑倒塌一事作调查,尚不清楚上述股东是否为相关政府部门的工作人员。

实地走访——“梅都房产” 注册地被多家公司“共享”

据工商登记查询系统显示,“梅都房产”的注册地位于闵行区莘朱路968号,营业期限从1995年12月12日至2015年12月11日,为国内合资的有限责任公司。该公司注册资本和实收资本均为1800万元人民币,经营范围是房地产开发(涉及许可经营的凭许可证经营)。但在记者试图前往该公司的注册地进行采访时,却发现莘朱路968号的门口并没有“梅都房产”的公司铭牌,反而显示这里是上海迅豪置业有限公司办公地。就连门口的保安也称,在此工作了一年多从来没有听说过“梅都房产”的存在。事后,记者查询了相关资料,竟然发现莘朱路968号曾被多家公司在工商部门注册登记。其中,除了“梅都房产” 以外,至少还有上海海迅置业发展有限公司、上海古龙置业有限公司和上海迅豪置业有限公司等三家公司。特别值得关注的是,上海迅豪置业有限公司的法定代表人阙敬德也是“梅都房产”的投资股东。

股东身份——第二大股东 和梅陇镇镇长助理同姓名

在记者获取的“梅都房产”公司登记资料中,显示该公司目前共有24名自然人投资股东,其投资额从11.25万元至1158.75万元不等。

其中,除了出资比例占64.375%的控股大股东张志琴外,出资额270万元的“梅都房产”第二大股东格外引人注目。这是因为,这位名叫阙敬德的男子,非但同时身为上海迅豪置业有限公司的法定代表人,而且在闵行区政府网站上,“阙敬德”其名还拥有多个现任的公务职位。

按照时间排序,闵行区政府网站上对于“阙敬德”的信息描述分别包括:1、2002年,“(检察机关)对原梅陇征地服务所所长阙敬德以玩忽职守罪立案侦查,追缴赃款赃物及挽回经济损失1327万余元”;2、2003年,阙敬德在梅陇镇征地服务所获得“闵行区2003年度实事重点工程立功竞赛先进个人”的表彰;3、2007年,阙敬德被先后任命为“闵行区梅陇镇动拆迁指挥部”副总指挥、沪杭磁浮工程建设(上海段)闵行区指挥部梅陇办公室工作组组长……关于“阙敬德”最近的一条官方信息显示于闵行区党务公开网,在该网站于今年2月11日发布的《关于成立梅陇镇“迎世博600天行动计划”总指挥部的通知》中,清晰地显示,“阙敬德”的职位为“镇长助理、资产公司总经理”。

与此同时,晨报记者在“梅都房产”其余股东名单中,还发现了和“阙敬德”一样,与闵行区相关政府机构公务人员同名同姓的现象。

为弄清上述名单和公务人员的姓名重复是否属于偶然,记者昨天下午反复尝试和闵行区梅陇镇镇政府等部门联系核对,但均未得到有关部门的正面应答。

在该网页中还有一张规划图,标注着“上海罗阳河畔小区详细规划图——总平面规划”字样,下方标有“梅陇镇26号地块旧村庄改造项目”,图上有手写标注出“罗阳河畔”是小区暂名。据提供网页链接的业主表示,从这张规划图所标注的小区范围与现在的“莲花河畔景苑”所在位置一致。但该业主提出,在该规划图中,住宅的图示上标有“11”与“6”的字样,右上方则有“小高层住宅”、“多层住宅”的图例;图例上也标有“11”与“6”的字样,业主认为这一数字应是住宅楼层数。

上海现代建筑设计集团高级工程师孟先生仔细看过规划图后介绍,如果这张图纸确为罗阳河畔小区详细规划图,那该规划图纸记录的规划范围与现在的“莲花河畔景苑”所在位置是一致的。

在看完总平面规划图后孟工表示,规划图图例中的数字“11”与“6”确实是表示该住宅楼的设计楼层,因此根据规划图,该小区一共有10幢住宅楼,其中8幢为11层的小高层,2幢为6层高的多层。图中标示的红色规划用地界线,离淀浦河防汛墙距离为50米。对于规划中的11层、6层为何变成了现在的13层,孟工说:“一种可能是开发商在这份规划图批复后,又第二次审请了规划更改,如果是这样,那更改的批复在相关部门应该还有备案。另一种可能是开发商私自进行了楼层的增加,那增加的部分将无法按正常情况办理产证,并会受到主管部门处罚。”孟工最后表示,楼层增加对地基及桩基数量等要进行重新设计。抢险作业预定目标初步实现,下一步开展房屋检测和事故调查工作
