本剧的故事跨度从1939年冬到1949年秋，展现了中国共产党领导的人民司法制度早期诞生、发展的历史缩影，是为纪念中华人民共和国成立六十年大庆和最高人民法院成立六十周年而创作拍摄的。

本剧主人公的原型叫马锡五，曾任陕甘宁边区政府专员、陕甘宁边区高等法院陇东分庭庭长，新中国建立之初，担任最高人民法院副院长。他在担任庭长期间，改变旧衙门官老爷式的审判作风，走群众路线、以调解为主，受到人民群众的爱戴和拥护，老百姓亲切的称他为“马青天”，他方便群众诉讼的审判方式，被称为“马锡五审判方式”。毛主席在延安亲笔给他题字“一刻也不要脱离群众”。马锡五的审判方式被西方人称为“东方审判经验”，对创建新中国司法制度产生过深远的影响，今天在以胡锦涛总书记为代表的党中央提出的执法为民、创建和谐社会中同样具有现实意义。

这是一部为新中国老一辈司法工作者树碑立传，向农民兄弟姐妹鞠躬致敬的作品。片中大部分角色，都是请当地农民来饰演，片中的陕北民歌和片尾曲，都是由当地农民歌手演唱的，原汁原味，体现出本剧的一种独特的风格。
