临时绿卡两年转正

通过与美国公民的婚姻，来获得的绿卡，多只有两年的有效期。而不是通常的十年。
盖起原由，不外乎以减低欺诈的可能性。
除了公民配偶的绿卡是两年期外，其跟随的同时移民的子女的绿卡也是相同的有效期。
所以，在到期之前，临时绿卡需要申请转正。转正所用的表格就是 I-751.
与绿卡结婚而获得的绿卡，也有两年临时一说。但是由于这一类的排期通常都是在两年之上，拿到绿卡时已经是在结婚两年之后了，所以就径直是十年期的绿卡。
临时绿卡申请转正，不是持有人一个人就可以办的，必须和公民身份的配偶一起申请。另外，临时绿卡身份的移民子女，如果是与家长同时申请的绿卡并且在其家长入境 90 天之内入境，就能在其家长的转正申请中一笔带过。否则，该子女需要单独申请来进行转正。
上面提到的转正申请，需要和公民一起申请。如果公民不签字，是不是就不能申请了？
移民局说，单独申请也行，但是得满足下面的条件之一：
１）公民已经往生；
２）婚姻终止；
３）临时绿卡受虐待；
４）不转正被逐将导致极大艰难。
什么时候申请转正？
如果是和公民一起申请，在临时绿卡到期前 90 天中；如果是上面单独申请的情形，任何时候均可。
如果没有及时申请转正，会怎么样？临时绿卡失效之后，其持有人就失去了身份，就能进入驱逐之列了。
但是，在临时绿卡失效之后，仍可提交转正申请。申请人需要附信解释延误之由。如果移民局认可你的延误之由，并且延误之期在合理范围，则将你的身份失效一笔勾销。
怎么知道一笔勾销了呢？你的迟交的I-751 申请被接受了，便是。

如果是夫妻共同申请，提交一切可以证明夫妻关系仍在维系的文件，这些文件没有定制，多多善益。
申请文件清单：

申请的邮寄地址，分别为东西两大中心之一。
投资移民(EB-5)的绿卡也是两年期的，需要在失效前 90 天内申请 I-829 来转正。其收据可将临时绿卡延长六个月，或直至 I-829 处理完毕。
临时绿卡何时转正与将来的入籍毫无关联。
另外，转正不再需要面试。

If the kids is old than 14 years old, the kids have to 单独申请 for green card. I did apply the green card with my son, because the day I submit the documents was one day passed my son's 14 birthday, he did apply 单独申请.
