请教PJIANG老师,关于O-1申请,一个律师的回答

先把BACKGROUND再陈述一遍:

我老婆2005年申请了NIW, 140批准,我们的485 PENDING (我是dependent),我有EAD但是一直没用(2009.1-2010.1).
我的H1将在两个月内到六年的期了....因为我是老婆NIW申请的dependent,所以不能享受H1六年后延期的规定.

我已经申请了一个O-1,PENDING....

如果这个O-1在我的H1失效后才批准,在GAP期间我用了EAD,那么O-1批准后我可以直接用O-1吗?

You are asking a question that is in the grey area of the law. Technically, your O-1 petition were filed when you were in valid H-1B status. Working on the EAD in the mean time, may complicate this and could make you ineligible for a change of status. Therefore, if you wish to avoid possible complications, I recommend applying for premium processing at this time.
