carry over -- urgent! xiaobaitu and experts help!

My husband\'s company filed EB3 for him in August 2005. He got both of PERM and I140 approval before Jan 2006. His company filed another EB2 for him this April, unfortunately it is denied. His lawyer used same title for both of EB3 and EB2 and different job deion. Now his lawyer withdraw EB2 and let him to try EB2 again with different title and job deion.

My questions are following:
1. I wonder if the denied EB2 will effect his new one, even the lawyer withdraw it.
2. Is it possible for him to get approval if he apply EB2 again?
3. I heard one person carry over from EB3 to EB2, both of I-140 approval, but he got refs after he file his 485. I wonder if it is possible way for my husband try it again.
