正在审核中的EB-3 I140申请可否premium processing?

As our readers are aware, the additional filing fee for the expedited premium processing service is $1000 and, in return, USCIS will issue a decision on a premium processing I-140 within 15 days of filing. Premium processing is slated to begin for EB-1 and EB-2 petitions (except National Interest Waiver cases) in the coming months. Some EB-3 cases that are not eligible for premium processing include the following: * A second I-140 filing if the initial I-140 is still pending * A labor certification substitution request * A duplicate labor certification request (where the original labor certification is not included) USCIS has determined that the above named cases involve additional processing steps and cannot be included in premium processing.
