Concurrent Filing 申请将可能结束

据USCIS表示，在未来的时间里将有可能不再接受I-140与I-485的同时申请(Concurrent filings) ，即申请人必须在其I-140被批准后才可以提出I-485申请。但就目前来说，如果申请人只要有一个Current priority date，其仍然可以同时申请I-140及I-485。以下为有关消息： Always unpredictable, USCIS has indicated that at some time in the future it will disallow concurrent filings of Immigrant Visa Petitions (I-140s) and Applications to Adjust Status (I-485s) even if there is a current priority date. This news will change the employment-based petition filing procedure, in that beneficiaries will need to have an approved I-140 as well as a current priority date in order to file their I-485. Please note that at this time applicants are still allowed to concurrently file their I-140 and I-485 if they have a current priority date. It is predicted by some that this change will take place at that same time that certain I-140s, I-765s, and I-539s are included in premium processing. If you have not heard about this announced but not yet enacted change, please click here. It is not clear at this time whether concurrent filing will still be available to National Interest Waiver applicants, since premium processing will not be available to them.
