Naturalization adjudications are subject to a unique law allowing lawsuits in federal court if USCIS has not adjudicated a case within 120 days of the naturalization examination. Unfortunately, this 120-day requirement is not imposed in other cases, such as in the instance of adjustment of status applicants. As such, in order to avoid the adjudication of an increasing number of naturalization cases being turned over to the federal courts, USCIS will begin preventing the scheduling of a naturalization interview until all background checks have been completed. This will include both the FBI name check and FBI fingerprint check.
