The Department of State has released the September 2006 Visa Bulletin. Like the August bulletin, this bulletin shows no forward movement for the second preference Employment Based category. However, first preference category applicants from India will notice that their category is now current. There was also some strong movement in the EB-3 category for applicants from China and the Philippines as well as in the Worldwide category. Please see below for further discussion. Remember that if you are a Labor Certification beneficiary, your priority date is determined by the date on which your employer filed your Labor Certification. If you skipped the Labor Certification stage, then your priority date is the date on which you filed your I-140.  If your priority date is current and you have not yet filed your I-485 Application to Adjust Status, you should prepare your materials now for filing on the first business day of next month. If you would like to learn more about what to do once your priority date is current and you have already filed your I-485 Application to Adjust Status, please click here and here. For the second consecutive month the second preference Employment Based category for applicants from India is listed 揢navailable.?span style="mso-spacerun: yes"> In essence, this means that as of August 1, the visa numbers in this category became unavailable. Applicants in this category will not be able to file their I-485 Applications to Adjust Status nor proceed with consular processing regardless of their priority date until the numbers become available again. After the beginning of the next fiscal year, which is October 1, it is likely that these numbers will be re-issued. Please note that applicants in this category remain eligible to file Labor Certifications and I-140 Immigrant Visa Petitions at this time ?they are simply not eligible to file I-485 Applications to Adjust Status.   EB-3 Visa Availability in the Coming Months Dates in the EB-3 category have been progressing rather quickly in recent months. As a result, applicant demand for visa numbers at USCIS offices is expected to increase. DOS warns that such advances cannot be expected to continue during the coming months. Indeed, because the Department of Labor is expected to complete its backlog reduction effort during the 2007 fiscal year making tens of thousands of cases with very early priority dates eligible for processing by USCIS, DOS notes that further retrogression of EB-3 dates could occur at any time during this fiscal year. www.fan-law.com (Chinese)  www.fanuslaw.com (English) CALIFORNIA : Fan, Fitzpatrick & Thompson, LLP. 370 E.
