我们知道，有些机构的职位不受H1B配额的限制，这些机构包括高等教育机构、高等教育机构相关的或附属的非营利实体、非营利的研究机构，或是政府研究机构。最近USCIS就这一规定作了进一步的澄清。
其实，这些机构的定义本身是很直接而清楚的，没有疑义。有疑义的是原文中的“employed or has received an offer of employment at” 有 关的这些机构。即使申请人并不是在上述的这些机构工作，如果雇主能够证明申请人的工作与这些不受配额限制的机构的工作有关，则申请人仍然不受H1B配额的限制。下面的例子能帮助我们理解这一规定。
1.公司A是一个商业性的市场营销公司，当然是以营利为目的，这样的公司当然受H1B配额限制。但是，如果公司的某个新雇员将主要在某一政府部门的研究机构工作，从事与这一政府研究机构其他雇员相类似的工作，这一雇员将不受H1B限额限制。
2.公司B，一个商业性的以营利为目的的研究性公司新雇用了一名外国雇员。公司与临近的一家大学有协议，允许这名雇员使用大学的试验室为公司工作。这种情况下，这名外国雇员是否受H1B名额限制呢？答案是：是，因为这名雇员使用大学的实验室是为公司工作，而不是为大学的研究目的而工作。
USCIS进一步定义了什么是“related or affiliated nonprofit entity” 。定义如下：the entity must be “connected or associated with an institution of higher education, through shared ownership or control by the same board or federation operated by an institution of higher education, or attached to an institution of higher education as a member, branch, cooperative, or subsidiary.”
而对于非营利机构(nonprofit research organization) 的定义则如下： “an organization that is primarily engaged in basic research and/or applied research.”
政府研究机构的定义如下： “a United States Government entity whose primary mission is the performance or promotion of basic research and/or applied research.”
