    can you file suit and win? yes, will it worth your time? depends...


    haha, the case is clearly cut and dry, the tenant move out and you lost rent due to failure to perform a legal contract, so if you file suit, whether you pay for an attorney or DIY, you should have no problem getting a judgment.


    the next question is, how would you like to collect that judgment?


    1. collect it yourself thru court system, let me tell you, it can be years before you see a dime, and you will be spending countless hours pursuing it.


    2. go with a collection agency, collection fee usually 50% of money recovered, sometimes you may need to pay a small fee upfront.


    3. pay an attorney to do it for you..haha, this will be the worst, at the end, you may not see a dime even if it is collected.


    haha, I do it, just because I am bored, it is about only thing still excites me...but if you hold a professional job, you should think about it is worth your time...


    or just get a judgment, and sit on it..incase this guy own any real properties, that judgment will become 1st lien on any real properties bear his name.

    Today is a good day, haha, one deadbeat turn himself in, and pay to bond himself out, $1100, court will disburse that on 4/11.

    and better yet, another deadbeat pay $500 cash toward his judgment, and agree to pay $100 toward the remaining balance, so I recall the civil warrant against him.

    currently Under Eviction 2
    waiting on judgment on back rent/damage 4
    pursuing collection 11
    paying or under garnishment 4
    civil warrant ( dead beats, hopefully policy will pick the up for up to 6 month jail time ) 14

    Case dismissed due to serviceable address 4
    Case dismissed due to death 1
    Case dismissed due to bankruptcy 3
    Case paid or settled 36

    Haha, Monday night, I will stand in front of the zoning board, not for, but possibly motion to against a nearby commercial expansion..


    Meijer's, a regional super store chain, plan to build a super Meijer's near a highway intersection, we own 2 parcels near by one of their purposed entrance, both commercial and residential, haha, so far I do not like their traffic study, so I am ready to state my case, and voice my concerns.


    The Meijer's expansion will no doubt double the real estate value near by, but will also draw much more commercial traffics thru the area, but their traffic study only recommended some minor change to traffic flow as now, and I want them to spend the money to upgrade the intersection.


    I had meet the Meijer's project manager last week, but their answer so far not satisfy me, so, I will voice my concern before the zoning board, haha, since I know 2 out of the 6 board members, maybe Meijer will reconsider...


    haha, anyway, win or lose, I really don't care, because with potentially double the real estate value on my parcels, I am happy either way, but with a better street and better traffic flow, it may still farther increase the real estate value for all near by properties..


    haha, of course, if they offer to buy my properties out, that is even better, haha, just dreaming..

    February is somewhat better then the previous 3 months, usually we see big improvement when spring comes around, hopefully March/April be a good month.

    of the 5 cases (2 evictions, and 3 failure to perform on contract) I file with small claims court in January, only 1 end up in trial, and because the service address was not any good, that hearing was postponed.

    also, I got notice I lost 1 collection, due to the guy file for bankruptcy.
